General Terms and Conditions

1. Scope & provider

The provider and contracting party is Innovation & Kooperation Scheiber GmbH, Ahornweg 4, 95643 Tirschenreuth, Deutschland ([managing director/contact: … to be added]).

These terms apply in the version valid at the time of the order to all orders via longcovid.expert. We do not accept conflicting terms unless we have expressly agreed to them.

2. Subject of the service

The subject is a one-time, physician-guided genetic orientation report for Long COVID / ME-CFS based on a saliva sample (sequencing by CeGaT in Germany, analysis by PrecisionLife).

• •The report is non-diagnostic: no diagnosis, no therapy, no promise of cure.
• •It does not replace a medical examination, advice or treatment.
• •It is intended for persons aged 18 and over.

3. Physician-guided process (GenDG)

The genetic test is physician-ordered under the German Genetic Diagnostics Act (GenDG). The process comprises an initial consultation/teleconsultation, the medical order, the saliva kit, laboratory analysis, medical release and provision of the report.

The treating physician decides independently; medical release is a prerequisite for creating and providing the report. If there is no medical indication or suitability is lacking, the service may be declined.

4. Conclusion of contract

The free initial enquiry is non-binding and does not trigger any payment obligation.

By ordering, you make a binding offer. The contract is concluded upon our confirmation (order/payment confirmation by e-mail). The start of the physician-guided service additionally depends on the medical order.

5. Prices, payment & instalments

• •Payment is processed via our payment service provider (Stripe).

• •There are no hidden costs; the stated total price is decisive.

6. Your cooperation & requirements

• •You are at least 18 years old.
• •You provide truthful information and take the saliva sample according to the instructions.
• •You ensure a correct shipping/contact address and availability for the medical consultation.

7. Right of withdrawal

As a consumer you have a statutory right of withdrawal. Details and the model withdrawal form are in the withdrawal policy (linked in the footer).

Note: for services, the right of withdrawal may expire early if performance began with your express consent before the period ended; for sealed samples/hygiene items, statutory exceptions apply.

8. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For ordinary negligence we are liable only for the breach of a material contractual obligation (cardinal duty), limited in amount to the foreseeable damage typical for the contract. As the report is non-diagnostic, you always make health-related decisions in consultation with a physician; liability for unilateral conclusions is excluded as far as legally permissible.

9. Final provisions

• •The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected.
• •Should any provision be invalid, the remainder of the contract remains valid.
